Terms of Use

1. The Site

The Site is operated by Five Four North. It provides information about our services and a means to contact us. It is not a client portal, an online store, or a self-service registration system.

2. No professional engagement

Information on the Site, including descriptions of service plans and rates, is for general information only. It is not an offer, and use of the Site does not create a professional-services relationship.

We provide services only under a separate written agreement. If these terms conflict with that agreement, the written agreement controls for the services it covers.

3. Switchboard

Switchboard is a client console made available in connection with eligible engagements. Access is provided only after an agreement is in place. Your existing accounts and systems remain yours. Access to Switchboard ends when the applicable engagement ends, unless otherwise agreed in writing.

4. Acceptable use

You may use the Site for lawful purposes. You may not attempt to gain unauthorized access to the Site, interfere with its operation, submit malicious code, or use the contact form to send unsolicited or unlawful content.

5. Intellectual property

The Site and its content, including text, graphics, logos, and images, are owned by Five Four North or its licensors and are protected by applicable intellectual-property laws. You may not copy, modify, or redistribute Site content except as permitted by law or with our prior written consent.

6. Disclaimer

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, Five Four North disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

7. Limitation of liability

To the fullest extent permitted by law, Five Four North will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site. Our total liability arising out of the Site will not exceed one hundred U.S. dollars (US $100).

This limitation applies only to use of the Site. It does not limit liability that we accept under a separate written services agreement.

8. Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Exclusive venue for disputes arising from these terms or the Site is the state or federal courts located in California.

9. Changes

We may revise these terms from time to time. The effective date at the top of this page will change when we do. Your continued use of the Site after a revision constitutes acceptance of the updated terms.
